Such language appears in the DOJ\u2019s new filing.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Breaking News: U.S. DOJ Reveals That Prosecutors May Argue That CZ Should Be Sentenced To 10 Years In Prison<\/p>\n<p>The U.S. Department of Justice (DOJ) charged ChangPeng Zhao (CZ) with, and CZ pled guilty to, one count of violating the Bank Secrecy Act. The charge stems from a mammoth\u2026 <a href=\"https:\/\/t.co\/gJ5EsB082Q\">pic.twitter.com\/gJ5EsB082Q<\/a><\/p>\n<p>\u2014 John Reed Stark (@JohnReedStark) <a href=\"https:\/\/twitter.com\/JohnReedStark\/status\/1728755992639287376?ref_src=twsrc%5Etfw\">November 26, 2023<\/a><\/p><\/blockquote>\n<p> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>On November 21, in the course of <a href=\"https:\/\/u1f987.com\/en\/news\/changpeng-zhao-to-pay-50-million-under-u-s-doj-settlement\">a deal with the agency<\/a> the exchange paid $4.3 billion, and CZ <a href=\"https:\/\/u1f987.com\/en\/news\/media-changpeng-zhao-to-step-down-as-binance-to-pay-4-3-billion-in-penalties\">agreed to<\/a> step down as CEO and pay a $50 million fine.<\/p>\n<p>He <a href=\"https:\/\/u1f987.com\/en\/news\/binance-founder-changpeng-zhao-released-on-175-million-bond\">posted a $175 million bond<\/a>, to remain free until the verdict on February 23, 2024. However, prosecutors <a href=\"https:\/\/u1f987.com\/en\/news\/prosecutors-seek-to-bar-cz-from-leaving-the-united-states\">petitioned to bar<\/a> the former head of the platform from leaving the United States, citing flight risk, including substantial wealth abroad and limited ties to the country.<\/p>\n<p>The prosecution had then stated that the former Binance chief did not provide clear and convincing evidence that he would not flee if he returned to the UAE.<\/p>\n<p>On November 23, the lawyers<a href=\"https:\/\/u1f987.com\/en\/news\/lawyers-challenge-motion-to-bar-changpeng-zhao-from-leaving-the-united-states\">challenged the motion<\/a> to bar Zhao from leaving the United States.<\/p>\n<h2 class=\"wp-block-heading\"><strong>A hint at a lengthy sentence<\/strong><\/h2>\n<p>Former SEC attorney John Reed Stark noted that, unlike the earlier motion, prosecutors were clear and unequivocal that, when delivering sentence, they could insist that CZ be sentenced to ten years in prison.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cUnder the guidelines, the maximum term [\u2026] may be up to 18 months. The United States may seek any punishment up to the ten years provided by law. [\u2026] The term [\u2026] will seem significant to him. This argues in favour of the proposed reasonable constraints\u201d,<\/em> \u2014 the motion says.<\/p>\n<\/blockquote>\n<p>The district judge Brian Cuchida set November 27 as the deadline for revisiting his decision on CZ\u2019s bail before the verdict.<\/p>\n<p>Reid Stark allowed that the judge, Richard A. Jones, might strike a compromise, adding conditions to release, demanding new assurances from the lawyer and Zhao, ordering more frequent interactions, or requesting other, more concrete safeguards. The expert did not rule out a delay in the decision.<\/p>\n<p>The former SEC lawyer warned that Zhao, still at large, could help perpetuate money-laundering in the industry. Ultimately, the department\u2019s deal with Zhao could backfire on the DOJ.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cLet\u2019s hope the officials have something up their sleeve. Or perhaps monitoring Binance and other corrective measures will uncover more egregious and punishable crimes. Otherwise, the dismantling of the company could be a slap in the face to CZ. And, unfortunately, an historic injustice of epic proportions,\u201d<\/em> \u2014 warned Reid Stark.  <\/p>\n<\/blockquote>\n<h2 class=\"wp-block-heading\"><strong>An unpopular view<\/strong><\/h2>\n<p>Omid Malekan, an adjunct professor at Columbia Business School, noted that the Binance settlement with U.S. authorities underscores a nuanced stance toward crypto firms. Opponents of the industry genuinely believe that \u201cdigital assets are a particular tool that enables bad actors to do bad things,\u201d he added.<\/p>\n<p>Such scrutiny contrasts with what is happening in the rest of the financial system. In his view, firms that follow best AML practices are still handling large sums of illicit funds.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cAll of this is treated as normal because someone filed the paperwork,\u201d<\/em> the expert explained.<\/p>\n<\/blockquote>\n<p>Malekan stated that many on Wall Street could be in prison if TradFi faced the same treatment as Binance in similar cases.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Some thoughts on the Binance settlement, with the preamble that I think companies that don\u2019t like certain laws should still comply with them while campaigning for change.<\/p>\n<p>One interpretation of the government\u2019s suit and the resulting mammoth settlement is that by refusing to\u2026<\/p>\n<p>\u2014 Omid Malekan ??\u200d\u2642\ufe0f (@malekanoms) <a href=\"https:\/\/twitter.com\/malekanoms\/status\/1727363668281524692?ref_src=twsrc%5Etfw\">November 22, 2023<\/a><\/p><\/blockquote>\n<p> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cBinance was wrong to lie to its customers and wrong to not comply with the requirements. But that doesn\u2019t mean it\u2019s a bad company. Do a five-minute Google search for \u2018banks aiding money laundering,\u2019 and you\u2019ll see that financial firms with well-known names have been implicated in much worse things, involving orders of magnitude more money.
