{"id":84101,"date":"2023-09-06T18:46:36","date_gmt":"2023-09-06T15:46:36","guid":{"rendered":"https:\/\/forklog.com\/en\/?p=84101"},"modified":"2025-09-12T15:18:59","modified_gmt":"2025-09-12T12:18:59","slug":"court-orders-asset-freeze-on-celsiuss-former-ceo","status":"publish","type":"post","link":"https:\/\/u1f987.com\/en\/court-orders-asset-freeze-on-celsiuss-former-ceo\/","title":{"rendered":"Court orders asset freeze on Celsius&#8217;s former CEO"},"content":{"rendered":"<p>A New York district court <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.601957\/gov.uscourts.nysd.601957.28.0.pdf\">ordered the freezing of assets<\/a> of Celsius&#8217;s former chief executive Alex Mashinsky during the pendency of his criminal case.<\/p>\n<p>This concerns Goldman Sachs bank accounts opened in the name of Koala LLC, and residential property in Austin, Texas.<\/p>\n<p>The order, issued on August 16, has only now been disclosed, amid fears that the accounts could be drained before the freeze takes effect.<\/p>\n<p>In January 2023, the New York Attorney General <a href=\"https:\/\/u1f987.com\/en\/news\/new-york-attorney-general-sues-former-celsius-ceo-for-defrauding-investors\">charged<\/a> Mashinsky with defrauding investors of billions of dollars. The former Celsius CEO <a href=\"https:\/\/u1f987.com\/en\/news\/us-authorities-arrest-former-celsius-chief-executive\">was arrested<\/a> in July.<\/p>\n<p>In the same month, the U.S. Department of Justice brought seven more criminal charges against him and the platform, including securities fraud, manipulating the CEL token price, misleading investors, and conspiring to defraud customers.<\/p>\n<p>The <span data-descr=\"U.S. Securities and Exchange Commission\" class=\"old_tooltip\">SEC<\/span> and <span data-descr=\"U.S. Commodity Futures Trading Commission\" class=\"old_tooltip\">CFTC<\/span> also joined the case.<\/p>\n<p>Mashinsky did not plead guilty to any of the counts. He was later released on $40 million bail.<\/p>\n<p>In June 2022, Celsius <a href=\"https:\/\/u1f987.com\/en\/news\/celsius-token-plunges-50-amid-withdrawal-suspension\">halted withdrawals<\/a>, trading and transfers between accounts due to extreme market conditions.<\/p>\n<p>Following Celsius&#8217;s <a href=\"https:\/\/u1f987.com\/en\/news\/celsius-files-for-bankruptcy-protection\">bankruptcy filing<\/a>, the company reported a hole in the balance <a href=\"https:\/\/u1f987.com\/en\/news\/celsius-reports-a-1-2-billion-hole-in-its-balance-sheet\">of $1.2 billion<\/a>. In August it emerged that the company&#8217;s liabilities exceeded its assets <a href=\"https:\/\/u1f987.com\/en\/news\/gap-in-celsius-network-balance-sheet-amounts-to-2-85-billion\">by $2.85 billion<\/a>.<\/p>\n<p>In September, Alex Mashinsky <a href=\"https:\/\/u1f987.com\/en\/news\/alex-mashinsky-resigns-as-celsius-network-chief-executive\">stepped down<\/a> as chief executive.<\/p>\n<p>Creditors of Celsius are now voting on the <a href=\"https:\/\/u1f987.com\/en\/news\/court-orders-celsius-creditors-to-vote-on-sale-of-celsius-network-assets-to-fahrenheit-consortium\">sale of digital assets<\/a> to the Fahrenheit consortium.
