This was stated by SEC Chair Gary Gensler during a hearing of the U.S. House of Representatives Appropriations Subcommittee.<\/p>\n<p><iframe loading=\"lazy\" width=\"609\" height=\"343\" src=\"https:\/\/www.youtube.com\/embed\/ZDDWLeeiHv4\" title=\"Budget Hearing \u2013 Fiscal Year 2024 Request for the U.S. Securities and Exchange Commission\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen=\"\"><\/iframe><\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIn fact, the rules already exist [\u2026]. They are called \u2018securities regulation\u2019. There are also disclosure rules \u2014 when someone tries to raise money from the public,\u201d the official said.<\/p>\n<\/blockquote>\n<p>Georgia Democrat Sanford Bishop asked Gensler about the Commission&#8217;s readiness to issue a \u2018regulatory act clarifying the application of securities laws to cryptocurrencies\u2019.<\/p>\n<p>In response, the head of the SEC said that the regulation mentioned by the congressman does not require clarification. In his words, the market is governed by investor protection rules, though the industry is rife with &#8216;non-compliance with the law&#8217;.<\/p>\n<p>Gensler reiterated his position that the vast majority of digital assets, with the exception of Bitcoin, fall under the definition of securities.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cBehind almost all cryptocurrency tokens, without bias toward any particular one, lie groups of entrepreneurs [\u2026], and I would wager that most of you do not encounter decentralised, non-existent leadership,\u201d he explained.<\/p>\n<\/blockquote>\n<p>In 2023, the SEC flagged violations at<a href=\"https:\/\/u1f987.com\/en\/news\/sec-issues-wells-notice-to-coinbase\">Coinbase<\/a>,<a href=\"https:\/\/u1f987.com\/en\/news\/kraken-to-pay-30-million-to-settle-sec-charges\"> Kraken<\/a>,<a href=\"https:\/\/u1f987.com\/en\/news\/sec-accuses-gemini-of-selling-unregistered-securities\"> Gemini and Genesis<\/a>.<\/p>\n<p>In March, Gensler<a href=\"https:\/\/u1f987.com\/en\/news\/gary-gensler-suggests-proof-of-stake-tokens-could-be-securities\"> proposed<\/a> that tokens on the <a href=\"https:\/\/u1f987.com\/en\/news\/proof-of-stake-how-it-works-and-why-it-is-so-popular\">Proof-of-Stake<\/a> consensus algorithm could be considered securities under U.S. law.<\/p>\n<p>A month earlier, the head of the agency hinted at the possibility <a href=\"https:\/\/u1f987.com\/en\/news\/gary-gensler-hints-that-cryptocurrencies-should-be-treated-as-securities\">of recognizing all cryptocurrencies<\/a>, except Bitcoin, in this status. His position <a href=\"https:\/\/u1f987.com\/en\/news\/lawyers-criticize-gary-gensler-for-hints-about-crypto-status\">was criticised<\/a> by industry lawyers.<\/p>\n<p>Earlier, Gensler <a href=\"https:\/\/u1f987.com\/en\/news\/sec-chief-says-the-cryptocurrency-market-is-centralised\">described<\/a> the cryptocurrency market as centralised. He urged platforms to approach the SEC about declaring a given asset an investment contract. He also warned of possible <a href=\"https:\/\/u1f987.com\/en\/news\/sec-chief-signals-possible-enforcement-action-against-unregistered-crypto-exchanges\">prosecution of unregistered Bitcoin exchanges<\/a>.<\/p>\n<p>Coinbase chief Brian Armstrong<a href=\"https:\/\/u1f987.com\/en\/news\/coinbase-chief-calls-sec-policy-ruinous-for-us-financial-sector\"> called<\/a> the regulator&#8217;s policy detrimental to the U.S. financial sector.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Crypto firms&#8217; activities should be regulated under securities laws.
