The regulator described the decision as &#8216;well-founded and reasonably explained&#8217;.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Earlier, the Commission approved ETFs based on CME futures contracts registered with the <span data-descr=\"CFTC\" class=\"old_tooltip\">CFTC<\/span>; thus, the underlying assets of these funds are subject to strict oversight. The spot bitcoin market, by contrast, is fragmented and unregulated. The applicant did not present compelling arguments in favour of the thesis that CME&#8217;s oversight of futures trading would be sufficient to detect and deter fraud and manipulation in the spot market,&#8221; the statement said.<\/p>\n<\/blockquote>\n<p>In the regulator&#8217;s view, there is no contradiction in its actions, since spot and futures ETFs are &#8216;fundamentally different products&#8217;.<\/p>\n<p>Grayscale Investments <a href=\"https:\/\/u1f987.com\/en\/news\/dcg-chief-confirms-plans-to-convert-grayscales-bitcoin-trust-into-an-etf\">filed the application<\/a> to convert the GBTC trust into an exchange-traded fund in October 2021. In the same month, the SEC approved the first U.S. ETF based on Bitcoin futures \u2014 the Bitcoin Strategy ETF from ProShares.<\/p>\n<p>The Commission rejected Grayscale Investments&#8217; application, <a href=\"https:\/\/www.sec.gov\/rules\/sro\/nysearca\/2022\/34-95180.pdf\">stating<\/a> that the decision did not meet the product requirements for &#8216;prevention of fraudulent and manipulative acts [&#8230;], as well as protecting investors and the public interest&#8217;.<\/p>\n<p>In June 2022 the company <a href=\"https:\/\/u1f987.com\/en\/news\/grayscale-sues-sec-over-refusal-to-convert-gbtc-into-an-etf\">filed a lawsuit<\/a> against the regulator, alleging that the SEC &#8216;acts arbitrarily and capriciously&#8217;, violating the Administrative Procedure Act.<\/p>\n<p)Since February 2021 the GBTC shares have traded at a discount to the fund's net asset value.
