The conclusion was reached by members of the U.S. Senate Committee on Agriculture, Nutrition, and Forestry (which oversees derivatives trading) and CFTC Chair Rostin Behnam.<\/p>\n<p><iframe loading=\"lazy\" width=\"1904\" height=\"764\" src=\"https:\/\/www.youtube.com\/embed\/5tfe2TQGSs8\" title=\"WATCH LIVE: Senate Committee on Agriculture, Nutrition &#038; Forestry holds a hearing\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/p>\n<p>Behnam warned that the Commission&#8217;s rules contain &#8220;basic elements that have served markets for decades&#8221; that proved insufficient in the context of the FTX collapse. In particular, <span data-descr=\"U.S. Securities and Exchange Commission\" class=\"old_tooltip\">SEC<\/span>, unlike the CFTC, has the authority to require adherence to such basic safeguards as customer funds segregation and best execution.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em><em>\u201cWithout new agency powers, there will be gaps in the federal regulatory framework, even if other regulators act within their existing mandates,\u201d<\/em> <em>\u2014<\/em> Behnam said.<\/em><\/p>\n<\/blockquote>\n<p>The official touched on interagency conflicts, responding to suspicions of a bid to seize power. He said cooperation between the SEC and CFTC<a href=\"https:\/\/u1f987.com\/en\/news\/cftc-chief-calls-rumors-of-a-fight-with-the-sec-over-crypto-regulation-cynical\"> will continue<\/a>, but expanding the powers of the Commission he chairs would &#8220;fill the gaps&#8221;, he emphasised.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em><em>I believe the duties could be the same between [agencies] with comprehensive regulation. CFTC regulation works well when it is applicable<\/em>,<\/em> Behnam explained.<\/p>\n<\/blockquote>\n<p>As a successful oversight example, the official cited <a href=\"https:\/\/u1f987.com\/en\/news\/ftx-us-acquires-ledgerx-a-cryptocurrency-derivatives-exchange\"> LedgerX <\/a>, the FTX-group platform that provides services in the crypto-derivatives market. He stressed that the Commission did not have the authority to study violations by unregulated entities within the FTX group.<\/p>\n<p>Behnam also highlighted shortcomings in the oversight of rating agencies, which had given high marks to the governance of the cryptocurrency exchange run by Sam Bankman-Fried.<\/p>\n<p>Senator Kristen Gillibrand, co-author of <a href=\"https:\/\/u1f987.com\/en\/news\/us-senate-unveils-bipartisan-bill-to-regulate-crypto-industry\"> the Responsible Financial Innovations Act <\/a>, identified as issues requiring special attention the influence of foreign firms on US rivals, including offshore. She also noted risks from mergers and acquisitions.<\/p>\n<p>Behnam acknowledged that FTX documents to the CFTC regarding the LedgerX acquisition were, at best, a <a href=\"https:\/\/u1f987.com\/en\/news\/us-congressman-says-ftx-crisis-a-failure-of-crypto-industry-regulation\">notice filing<\/a>.<\/p>\n<p>Earlier, U.S. Representative Tom Emmer called the FTX crisis a <a href=\"https:\/\/u1f987.com\/en\/news\/cftc-to-create-new-division-to-oversee-cryptocurrencies\">failure of crypto-industry regulation<\/a>.<\/p>\n<p>In July, Behnam <a href=\"https:\/\/u1f987.com\/en\/news\/cftc-chair-warns-that-crypto-regulation-is-inevitable\">announced the creation<\/a> of the Office of Technology Innovation, which will regulate the crypto industry.<\/p>\n<p>In October, the official <a href=\"https:\/\/u1f987.com\/en\/news\/sec-chief-backs-expansion-of-cftc-powers-in-the-crypto-industry\">warned<\/a> participants in the digital-asset space of the inevitability of regulation.
