This is a legal principle allowing the regulator to refuse disclosure of documents or testimony, citing confidentiality of data and sources.<\/p>\n<p>The dispute over the regulator\u2019s application of this principle <a href=\"https:\/\/u1f987.com\/en\/news\/court-backs-ripple-in-sec-document-disclosure-dispute\">has been ongoing for several months<\/a>. In the verdict in that case, the court held that government agencies are responsible for linking a withheld document to a \u201cspecific decision\u201d or \u201cspecific decision-making process.\u201d<\/p>\n<p>According to the lawyers, the SEC was unable to do so, and therefore cannot rely on the DPP in the current proceedings.<\/p>\n<blockquote class='wp-block-quote is-layout-flow wp-block-quote-is-layout-flow'>\n<p>\u201cAs the NRDC case shows, the SEC must identify a specific decision-making process and explain how each withheld document relates to that process. Filan \ud83c\uddfa\ud83c\uddf8\ud83c\uddee\ud83c\uddea (@FilanLaw) <a href='https:\/\/twitter.com\/FilanLaw\/status\/1468696478722015247?ref_src=twsrc%5Etfw'>December 8, 2021<\/a><\/p><\/blockquote>\n<p> <script async='' src='https:\/\/platform.twitter.com\/widgets.js' charset='utf-8'><\/script><\/p>\n<blockquote class='wp-block-quote is-layout-flow wp-block-quote-is-layout-flow'>\n<p>\u201cBecause all withheld documents relate to a specific decision or decision-making process, the DPP protects them from disclosure,\u201d the SEC says in the letter.<\/p>\n<\/blockquote>\n<p>In addition, the Commission\u2019s lawyers stressed that the precedent at issue demonstrates the regulator\u2019s right to apply the DPP to \u201crecords regarding the agency\u2019s decision on how to convey its policy to outsiders.\u201d<\/p>\n<p>In their view, such documents include internal SEC communications about the content of speeches and other public communications.<\/p>\n<p>Earlier reports pointed to <a href=\"https:\/\/u1f987.com\/en\/news\/media-point-to-potential-conflicts-of-interest-in-sec-case-against-ripple\">a possible conflict of interest in the SEC\u2019s case against Ripple<\/a>.
