Its participants have not received answers, &#8216;the saga continues&#8217;, says former Compound Labs chief legal officer Jake Chervinsky.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">FATF published its updated crypto AML guidance today. It\u2019s marginally better than the March draft.<\/p>\n<p>As often happens, industry explained why the draft made no sense, &#038; FATF\u2019s reaction was just to make it more vague. No answers here. The saga continues.<\/p>\n<p>\ud83e\uddf5 of threads &#038; writeups:<\/p>\n<p>\u2014 Jake Chervinsky (@jchervinsky) <a href=\"https:\/\/twitter.com\/jchervinsky\/status\/1453764246278483971?ref_src=twsrc%5Etfw\">October 28, 2021<\/a><\/p><\/blockquote>\n<p> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Chervinsky gathered opinions from colleagues who arrived at similar conclusions.<\/p>\n<p>Director of policy <a href=\"https:\/\/u1f987.com\/en\/news\/what-is-decentralised-finance-defi\">DeFi<\/a> Education Fund under the handle millercwl is convinced that FATF sees a world in which decentralized and permissionless systems are, at best, suppressed.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">1\/ \ud83d\udea8 Long-ish thread on the crypto + DeFi guidance issued by the Financial Action Task Force.<\/p>\n<p>tl:dr, it\u2019s not great.<\/p>\n<p>My initial read is that the FATF sees a world in which permissionless + decentralized systems are\u2014at best\u2014suppressed.<a href=\"https:\/\/t.co\/JG2c0O9gvz\">https:\/\/t.co\/JG2c0O9gvz<\/a><\/p>\n<p>\u2014 Miller (@millercwl) <a href=\"https:\/\/twitter.com\/millercwl\/status\/1453712314939674629?ref_src=twsrc%5Etfw\">October 28, 2021<\/a><\/p><\/blockquote>\n<p> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>In his view, organisations will struggle to admit that DeFi will remove intermediaries in the form of banks and custodians.<\/p>\n<p>FATF proposed two overly broad recommendations:<\/p>\n<ul class=\"wp-block-list\">\n<li>limit the launch of public systems;<\/li>\n<li>expand the regulatory perimeter for providers of virtual assets (VASP).<\/li>\n<\/ul>\n<p>millercwl saw difficulties in deploying a DeFi protocol. Developers would be effectively forced to launch permissioned systems (with restrictions) due to the need to meet VASP requirements.<\/p>\n<p>Preventing the creation of software that does not fit existing regulatory regimes runs counter to a \u201ctechnologically neutral\u201d approach. It could also raise questions about constitutionality in the United States, the expert added.<\/p>\n<p>In millercwl\u2019s view, FATF players in the space seek to define DeFi as VASPs with \u201csome degree of control or sufficient influence\u201d over the protocol. Yet the organisation does not define these terms or explain how to apply the recommendations. Additionally, \u201csufficient influence\u201d is not spelled out in the legal and regulatory frameworks of the countries.<\/p>\n<p>The expert concluded that the guidance deprives developers of clarity on the criteria their projects must meet. They will either have to abandon innovation or accept higher risk.<\/p>\n<p>The lawyer argued that the proposed approach will not work. Public DeFi protocols already exist. The push to play a &#8216;Whack-a-Mole&#8217; globally to curb the emergence of new such projects would be impractical and undesirable. The expert proposed a new approach that preserves market efficiency and privacy.<\/p>\n<p>Despite the criticism, millercwl believes the consequences of the guidance will likely be limited due to the slow pace at which various jurisdictions approve them.<\/p>\n<p>The chief legal officer of the DeFi platform dYdX and co-chair of the DeFi committee at the Blockchain Association, Marc Boiron, said the FATF recommendations are so poor that, by comparison, the infrastructure plan looks better. He noted that the FATF\u2019s aim is to \u201cshoot\u201d DeFi.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">1\/ FATF published its recommendations. It\u2019s so bad that it makes the infrastructure bill look reasonable. <br \/>TLDR: Only permissioned DeFi is allowed. An intermediary must be inserted to serve as a VASP. The global impact of these recommendations is an attempted kill shot at DeFi.<\/p>\n<p>\u2014 Marc Boiron (Wannabe Shadowy Super Coder) (@boironattorney) <a href=\"https:\/\/twitter.com\/boironattorney\/status\/1453725920489922569?ref_src=twsrc%5Etfw\">October 28, 2021<\/a><\/p><\/blockquote>\n<p> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Boiron would also like to see the interpretation of \u201csufficient influence\u201d and \u201cactive facilitation,\u201d which carry a sweeping meaning.<\/p>\n<p>FATF leaves few mechanisms for handling virtual assets (VAs) without involvement from VASP. Applied to DeFi, the organisation believes most existing projects\u2014even if they identify as P2P platforms\u2014meet the definition of VASP to some degree, the expert said.<\/p>\n<p>Boiron\u2019s greatest concern was that the recommendations could apply to <span data-descr=\"decentralized organizations\" class=\"old_tooltip\">DAO<\/span>.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cIs a DAO \u2018a controlling party\u2019? That erodes DeFi\u2019s advantages in favour of <span data-descr=\"Traditional Finance\" class=\"old_tooltip\">TradFi<\/span>.<\/p>\n<p>Chervinsky finishes by noting that FATF provides guidance, but countries are not obliged to follow it. He reminded that the United States still has not implemented the rules issued in 2012 for lawyers, accountants and real estate agents. In 2016, the organisation drew attention to this, but the situation has not changed since.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Reminder: FATF gives guidance, it doesn\u2019t make law. Member countries often go their own way, the US especially.<\/p>\n<p>In 2012, FATF advised new regulations for lawyers, accountants, &#038; real estate agents. In 2016, FATF dinged the US for failing to implement them.
