The regulator said this on its <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/8450-21\">site<\/a>.<\/p>\n<p>Under the order, Tether was fined $41 million for \u201cfalse or misleading statements\u201d about full backing of the stablecoin USDT. The company is also required to refrain from further violations of the Commodity Exchange Act and CFTC rules.<\/p>\n<p>The penalty for Bitfinex for offering futures contracts on the platform without registration and for conducting off-exchange trades with U.S. residents amounted to $1.5 million. The CFTC demanded that the firm implement additional safeguards to prevent illicit transactions.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cAs today\u2019s actions against Tether and Bitfinex show, the CFTC remains committed to fulfilling its legally mandated duties to promote market integrity and protect customers in the United States,\u201d said Acting Director of Enforcement Vincent McGonagle.<\/p>\n<\/blockquote>\n<p>The attorney representing the company, Stuart Hoegner, explained that the CFTC did not find a lack of backing for USDT, and the regulator&#8217;s conclusions were based on the 2016\u20132019 period.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">The CFTC only credits backing in bank accounts in the name of #Tether . And Tether is now moving forward with audited financials, which for a long period were not available to us. 7\/8<\/p>\n<p>\u2014 Stuart Hoegner (@bitcoinlawyer) <a href=\"https:\/\/twitter.com\/bitcoinlawyer\/status\/1449075495056941060?ref_src=twsrc%5Etfw\">October 15, 2021<\/a><\/p>\n<\/blockquote>\n<p> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Hoegner added that USDT is fully backed, and Tether has never refused customers redemption.<\/p>\n<p>Earlier, the parent company of the bitcoin exchange and the stablecoin issuer \u2014 iFinex \u2014 filed a petition in the New York Supreme Court seeking to bar the media and other entities <a href=\"https:\/\/u1f987.com\/en\/news\/tether-issuer-seeks-court-injunction-to-bar-disclosure-of-usdt-reserve-data\">from requesting data on the status and structure of USDT reserves<\/a> over the past several years.<\/p>\n<p>In February 2021, the companies <a href=\"https:\/\/u1f987.com\/en\/news\/bitfinex-and-tether-to-pay-new-york-state-18-5-million-in-settlement-over-financial-operations\">entered into an agreement with the New York Attorney General<\/a> regarding the company&#8217;s financial operations tied to the loss of $850 million.<\/p>\n<p>This was aided by <a href=\"https:\/\/u1f987.com\/en\/news\/bitfinex-repaid-a-750-million-loan-taken-from-tether\">the repayment of a loan Bitfinex had taken from Tether<\/a> totaling $750 million, which prompted the regulator&#8217;s actions.<\/p>\n<p>In August, Bloomberg reported on <a href=\"https:\/\/u1f987.com\/en\/news\/bloomberg-reports-us-justice-department-has-opened-an-inquiry-into-tether-the-company-calls-the-news-clickbait\">a possible investigation of Tether by the U.S. Department of Justice<\/a>.
