{"id":39180,"date":"2021-03-18T18:28:17","date_gmt":"2021-03-18T16:28:17","guid":{"rendered":"https:\/\/forklog.com\/en\/?p=39180"},"modified":"2025-08-30T08:18:24","modified_gmt":"2025-08-30T05:18:24","slug":"lawyer-says-data-transfers-to-roskomnadzor-may-be-a-masked-attempt-to-bypass-communications-secrecy","status":"publish","type":"post","link":"https:\/\/u1f987.com\/en\/lawyer-says-data-transfers-to-roskomnadzor-may-be-a-masked-attempt-to-bypass-communications-secrecy\/","title":{"rendered":"Lawyer says data transfers to Roskomnadzor may be a masked attempt to bypass communications secrecy"},"content":{"rendered":"<p><span style=\\\"font-weight: 400;\\\">Russian authorities want to require telecom operators to provide Roskomnadzor (RKN) with subscribers&#8217; personal data, and to force businesses to forward anonymised data about Russians to the state at no cost.<\/span><!--more--><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">According to the <a href=\\\"https:\/\/regulation.gov.ru\/projects#npa=114142\\\" target=\\\"_blank\\\" rel=\\\"noopener\\\"><span style=\\\"font-weight: 400;\\\">draft government resolution<\/span><\/a><span style=\\\"font-weight: 400;\\\">, Roskomnadzor could access a wide range of subscriber data \u2014 full name, date of birth, place of residence and passport number.<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">Operators would also be required to pass data about all calls and the subscriber&#8217;s voice, text and multimedia messages.<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">The explanatory note says the decree is aimed at tackling \u2018grey\u2019 SIM cards registered to front individuals and used for fraud.<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">In the Ministry of Digital Development, Communications and Mass Media of the Russian Federation <a href=\\\"https:\/\/www.rbc.ru\/rbcfreenews\/605251f09a794723b02cd4a9\\\" target=\\\"_blank\\\" rel=\\\"noopener\\\"><span style=\\\"font-weight: 400;\\\">\u0437\u0430\u044f\u0432\u0438\u043b\u0438<\/span><\/a><span style=\\\"font-weight: 400;\\\"> that Roskomnadzor would not have access to the contents of messages and calls and \u201cthe secrecy of communications will be observed\u201d.<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">Representatives of MTS <a href=\\\"https:\/\/www.rbc.ru\/technology_and_media\/17\/03\/2021\/605206809a794702c7c67af8\\\" target=\\\"_blank\\\" rel=\\\"noopener\\\"><span style=\\\"font-weight: 400;\\\">\u043d\u0430\u0437\u0432\u0430\u043b\u0438 \u0438\u0437\u0431\u044b\u0442\u043e\u0447\u043d\u044b\u043c<\/span><\/a><span style=\\\"font-weight: 400;\\\"> and noted that, some of it relates to the secrecy of communications<\/span>.<\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">Lawyers also say that the data intended for Roskomnadzor are not needed by the agency to exercise its powers.<\/span><\/p>\n<p>\\n<\/p>\n<blockquote>\n<p><span style=\\\"font-weight: 400;\\\">\u201cInvestigating crimes against property, to which telephone fraud relates, is not within Roskomnadzor\u2019s remit. That is, I do not see any truly pressing reasons to hand over these data to Roskomnadzor specifically,\u201d said ForkLog partner at the Digital Rights Center, Mikhail Tretyak.<\/span><\/p>\n<\/blockquote>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">In addition, there are far less costly and more effective ways to combat phone scammers and \u2018grey\u2019 SIM cards, the lawyer noted.<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">He also noted that such data aggregation \u201cwill clearly lead to mass leaks.\u201d<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">In Tretyak&#8217;s view, the initiative may be an attempt to circumvent existing telecommunications secrecy laws, but \u201cthis time more careful than <a href=\"https:\/\/u1f987.com\/en\/news\/experts-on-ministry-of-digital-development-amendments-law-enforcement-authorities-would-have-unrestricted-access-to-russians-movements\"><span style=\\\"font-weight: 400;\\\">in the case of geolocation<\/span><\/a>\u201d.<\/span><\/p>\n<p>\\n<\/p>\n<p><span style=\\\"font-weight: 400;\\\">The lawyer noted that Roskomnadzor \u201cwith a very high degree of probability\u201d, upon obtaining subscriber data, would immediately pass them to law enforcement authorities:<\/span><\/p>\n<p>\\n<\/p>\n<blockquote>\n<p><span style=\\\"font-weight: 400;\\\">\u201cIn the case of geolocation, the security forces were mentioned outright; this provoked a very wide outcry.
