In many ways, it was the first major shot in the war against cryptocurrencies,\u201d he stated.<\/p>\n<\/blockquote>\n<p>In December 2020, the SEC filed a lawsuit against Ripple, accusing the company of selling unregistered securities in the form of XRP worth $1.3 billion. Garlinghouse and co-founder Chris Larsen were also named as defendants.<\/p>\n<p>In July 2023, Judge Analisa Torres of the Southern District of New York ruled that programmatic sales and other distributions of Ripple&#8217;s token did not constitute an offer and sale of investment contracts. However, the decision stated that sales of coins to large players violated securities laws.<\/p>\n<p>The SEC&#8217;s interim appeal was rejected by the court, which found insufficient evidence and deemed that its consideration would not \u201csignificantly advance the ultimate termination of the case.\u201d<\/p>\n<p>Subsequently, the Commission withdrew the lawsuit against Garlinghouse and Larsen. The parties reached a settlement, eliminating further charges on previous grounds.<\/p>\n<p>In August 2024, Judge Torres issued the <a href=\"https:\/\/u1f987.com\/en\/news\/court-reduces-ripples-fine-from-2-billion-to-125-million\">final ruling<\/a> on the case, fining Ripple $125 million. The regulator initially <a href=\"https:\/\/u1f987.com\/en\/news\/sec-seeks-2-billion-penalty-for-ripple-labs\">demanded $2 billion<\/a>. In October, the SEC <a href=\"https:\/\/u1f987.com\/en\/news\/sec-appeals-court-ruling-in-ripple-case\">challenged<\/a> the verdict.<\/p>\n<p>Following this, the agency <a href=\"https:\/\/u1f987.com\/en\/news\/sec-seeks-reconsideration-in-ripple-case\">took steps<\/a> to review previously court-adopted decisions regarding the erroneous application of the law. The Commission proposed revisiting the offers and sales of XRP on digital asset platforms, the involvement of Garlinghouse and Larsen, and the distribution of the token \u201cin exchange for consideration other than cash.\u201d<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cRipple was the first company with the resources, determination, and fortitude to fight against regulatory overreach, and today this journey finally concludes. This is a victory and a long-overdue capitulation by the SEC,\u201d Garlinghouse emphasized.<\/p>\n<\/blockquote>\n<p>He thanked industry participants for their <a href=\"https:\/\/u1f987.com\/en\/news\/better-markets-backs-sec-in-ripple-case\">support<\/a> of Ripple during the proceedings with the regulator. The entrepreneur particularly highlighted the role of the company&#8217;s chief legal officer, Stuart Alderoty.\u00a0<\/p>\n<p>Alderoty has already <a href=\"https:\/\/x.com\/s_alderoty\/status\/1902348432913641550\">stated<\/a> that the firm will consider how \u201cbest to file a counter-appeal\u201d against the SEC.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cToday, Ripple moves forward \u2014 stronger than ever. This remarkable case has set a precedent for the American crypto industry,\u201d he stressed.<\/p>\n<\/blockquote>\n<p>In light of the news, XRP prices <a href=\"https:\/\/www.coingecko.com\/en\/coins\/xrp\">surged<\/a> by approximately 15%.
